Terms of service
Last updated 24 October 2026
1. Who we are
FlakeVPS is operated by Nikita Molina Arevalo, a sole trader in Spain, C/ Maestro Jose Rodriguez, 18008 Granada, Spain, tax number (NIF) 75578408V. These terms apply whenever you create an account or use a server from us.
2. Your account
You must be at least 18 years old, or have permission from a parent or guardian, and give a working email address.
Keep your password and SSH keys safe. You are responsible for everything done with your account and on your servers.
The account owner can invite team members. The owner is responsible for what members do, and for the account's payments.
3. The service
We provide virtual private servers with root access. You choose the size, location and operating system. You administer the server yourself, including updates, security and software.
We aim for high availability but do not guarantee uninterrupted service. Maintenance or faults at our data center provider can cause downtime.
4. Acceptable use
You may not use a server to:
- send spam or bulk email that recipients did not ask for;
- attack, scan or break into other systems, or run denial-of-service traffic;
- host malware, phishing pages, or content that is illegal in Spain, in the European Union or in the server's location;
- mine cryptocurrency;
- infringe copyright or other rights of others.
Outgoing mail ports (25, 465 and 587) are blocked on new accounts. After one paid month you can ask us to open them; we may decline, or close them again after complaints.
We act on abuse reports. If a report is credible, we may stop the server immediately and contact you afterwards.
5. Prices and payment
Billing is prepaid. You add credit to your account by card or bank transfer. Each server, volume and IP address is paid one month in advance from that credit, and renews monthly on the day it was created.
Each size has a monthly price per location, shown before you buy. Prices exclude VAT unless stated otherwise.
The price of a running server does not change while it runs. New prices apply only to servers created after the change. Upgrades are charged for the rest of the current month when you make them.
If a renewal fails because your credit is too low, the resource is switched off after 3 days and deleted after 14 days.
If you save a card, you can turn on automatic top-ups: when a renewal is due and your credit is too low, we charge the card for the missing amount (at least €5), at most once a day. You can turn this off or remove the card at any time.
Credit is not paid out, except where the law requires it or when we end the service without a breach on your side.
5a. Domains
We register domains for you through Cloudflare, Inc. as registrar, under the rules of the registry for each ending (for .com, Verisign and ICANN). You are the registrant and must give true contact details; the registry may suspend a domain with false details.
A domain is paid one year in advance from your credit. Registrations and renewals cannot be refunded once made. The renewal is charged 45 days before expiry; if it cannot be paid by 32 days before expiry, the domain is not renewed and expires.
You can manage the domain's DNS records in your account. To move a domain to another registrar, contact support; we give you the transfer code.
6. Your data and backups
The data on your server is yours. We do not look at it except to investigate abuse or when required by law. We do not back up your server; keep your own backups. When you delete a server, its disk is erased and cannot be recovered.
7. Suspension and termination
You can cancel a server, volume or IP address at any time. It keeps running until the end of the month you paid for and is then deleted. You can also delete it at once; the rest of that month is not refunded.
You can delete your account in the account settings once its servers, volumes and IP addresses are deleted and its domains are transferred away. Remaining credit is lost unless you ask support for a payout first.
We may suspend or terminate a server or account for a breach of these terms, for unpaid invoices, or when the law requires it. Where possible we warn you first.
8. Liability
We are liable without limit for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties, limited to the damage typical and foreseeable for this kind of contract. We are not liable for lost data that a reasonable backup would have prevented.
9. Changes to these terms
We will email you at least 30 days before material changes take effect. If you do not agree, you can close your account before that date.
10. Law and disputes
These terms are governed by the laws of Spain. If you are a consumer, the mandatory consumer protection laws of your country of residence still apply.
